| The jurisprudence of order means order and order in three areas: referring to the sources of Sharia, paying attention to the five pillars of ijtihad, and examining the activities related to these pillars. In the field of ijtihad, it may seem at first glance that the jurisprudence of order is not of much importance in inference; however, it must be said that the inference operation, without paying attention to the jurisprudence of order in the positions where it is needed, in most cases - especially in more complex and larger-scale issues - is almost meaningless and should be considered a fruitless effort. The benefits of addressing the jurisprudence of order are facilitating ijtihad, increasing the quality of ijtihad, and reducing errors in ijtihad. Accordingly, the present study aims to explain and analyze the jurisprudence of order and its mechanisms in the jurisprudential method of Imam Khomeini. The previous study, using a descriptive and analytical method, has determined that a desirable inference requires the jurisprudence of order. Based on the findings of this study, Imam Khomeini, in the path of inference, completes the jurisprudence of order with four mechanisms such as: perspectives (idea, thought, theory), information, techniques, and organization, and a desirable inference must also follow such a path. |
