حمایت از طرح و بسته‌بندی محصولات در قالب شاخه‌های حقوق مالکیّت فکری

چکیده

طرح یا بسته‌بندی کالاها از جمله مقولاتی محسوب می‌شوند که ممکن است از طریق شاخه‌های مختلف حقوق مالکیت فکری مورد حمایت قرار گیرند و مسلم است که حمایت هر یک از شاخه‌ها متفاوت از سایرین خواهد بود. در مقالۀ حاضر برآنیم به این پرسش‌ها پاسخ دهیم که حمایت از طریق قالب‌های مختلف حقوق مالکیت فکری چه تفاوت‌هایی با یکدیگر دارند و حمایت از طریق کدام قالب حقوقی مناسب‌تر است؟ و اینکه آیا امکان حمایت چندگانه وجود دارد؟ مقاله کنونی با رویکرد تحلیلی- توصیفی سرانجام نتیجه گیری می‌نماید که هیچ یک از قالب‌های حقوقی به طور‌کامل بر سایر قالب‌ها ارجحیت ندارد و این طراح است که می‌تواند قالب مناسب برای حمایت از طرح خود را برگزیند. از طرفی در نظام‌های حقوقی مختلف، امکان حمایت‌های چندگانه میسر است.
