بیمه هزینه‌های قضایی: الگویی برای توانمندسازی شهروندان

چکیده

بیمه هزینه‌های قضایی از جمله ابزارهای تجربه‌شده در بسیاری از کشورهای جهان برای افزایش دسترسی شهروندان به عدالت به شمار می‌آیند؛ بااین‌حال ایران از جمله کشورهایی است که چنین تجربه‌ای در آن پا نگرفته است. این مقاله مطالعه‌ای کتابخانه‌ای با رویکرد تطبیقی است که از روش‌های توصیفی و تحلیل انتقادی حقوقی بهره برده  است. این مقاله می‌کوشد ضمن معرفی بیمه هزینه‌های قضایی و روش‌های جایگزینی که در حقیقت بیمه نیستند، اما مبتنی بر توزیع هزینه‌های سنگین خدمات قضایی هستند، الزامات شکل‌گیری بیمه‌های هزینه‌های قضایی را در نظام حقوقی ایران نشان دهد. بررسی‌های این مقاله نشان می‌دهد بازار غیر شفاف و غیر منضبط ارائه خدمات وکالتی تا چه اندازه مانعی بزرگ برای دسترسی به این مهم به شمار می‌رود. رواج بیمه‌ها نیازمند انضباط‌بخشی به بازار وکالت است. هم‌چنین در این مقاله منافع و مضار بیمه‌های قضایی  از منظر توانمندسازی حقوقی نیز بررسی می‌شود. بیمه‌های قضایی در عین اینکه می‌توانند ابزاری برای افزایش تسلط شهروندان بر زندگی خود باشند، قادرند به ابزاری جهت سلب اختیار شهروندان در پرونده‌های خود تبدیل شوند؛ بنابراین در ترویج بیمه‌های قضایی نباید مقررات‌گذاری برای بیمه‌گران را دست کم گرفت.
