تحلیل شمول یا عدم شمول اصل 75 قانون اساسی نسبت به لایحه ­ی ‌ بودجه

چکیده

اصل 75 ارائه‌ی آن دسته از پیشنهادها و اصلاحات نمایندگان مجلس نسبت به لوایح دولت که به افزایش هزینه‌ها یا کاهش درآمدهای عمومی منتهی خواهد شد را منوط به تعیین طریق جبران درآمد یا تأمین هزینه‌ی جدید نموده است. نوشتار پیش ‌رو با اتخاذ رویکردی تحلیلی- توصیفی، در مقام تبیین این مسأله است که آیا لایحه‌ی بودجه‌ مشمول الزام مندرج در اصل 75 قانون اساسی خواهد شد یا خیر؟
موافقان شمول اصل 75 نسبت به لایحه‌ی بودجه با استناد به فلسفه‌ی تصویب اصل 75، تمسک به‌ اطلاق عبارت «لوایح قانونی» مندرج در اصل 75، قیاس لایحه‌ی بودجه با لوایح غیرمالی و استدلال به شمول ضوابط عام قانونگذاری نسبت به لایحه‌ی بودجه معتقد به رعایت الزام مقرر در اصل 75­ نسبت به لایحه‌ی بودجه هستند. در مقابل، مخالفان با استدلال بر عدم تحقق مسأله‌ی بار مالی نسبت به لایحه‌ی بودجه، استناد به رویه‌ی عملی و نظریه‌ی مشورتی شورای نگهبان و ماهیّت اجرایی قلمداد کردن لایحه بودجه و پذیرش اقتضائات آن معتقد به عدم رعایت الزام  مقرر در اصل 75  نسبت به لایحه‌ی بودجه هستند.
مناسب‌ترین پاسخ به پرسش این پژوهش، عدم شمول اصل 75  نسبت به لایحه‌ی بودجه است. البته، مشروط به آنکه فقدان الزام نمایندگان به ارائه‌ی راه جبران کاهش درآمدها یا تأمین هزینه‌ها اولاً، به مثابه مجوزی برای اعمال تغییرات گسترده در لایحه‌ی بودجه تعبیر نشود و منتهی به استحاله‌ی «لایحه‌ی بودجه» به «طرح بودجه» نگردد، ثانیاً تغییرات مذکور منجر به جابجایی قابل توجه سقف درآمدها و هزینه‌ها نگردد و منجر به بر هم زدن توازن درآمدها و هزینه‌ها نشود.
