تحلیلی بر اصول، چالش‌ها و ‌راهکارهای ‌ارتقای‌کیفیت قانونگذاری؛ با ‌‌‌‎‎‎‎تأکید بر قانونگذاری تأمین ‌اجتماعی

چکیده

برای تدوین قوانین باکیفیت، اصول و موازینی تعیین شده که هدف از وضع آنها، تأمین سازگاری قانون با اهداف قانونگذاری است. اصول عام قانونگذاری مانند اصول ماهوی، شکلی و فنی  معیارهایی‌ برای تشخیص قوانین باکیفیت هستند. علاوه براین، قانونگذاری در حوزه‌های مختلف زیست اجتماعی، سیاسی و اقتصادی مستلزم کاربست اصولی خاص و متناسب با آن حوزه می­باشد. استانداردهای حقوقی بنیادین نظام تأمین اجتماعی و اصول مالی، اقتصادی و بیمه‌ای از جمله اصول خاص قانونگذاری تأمین اجتماعی است. نادیده گرفتن اصول عام ناظر بر تقنین و اصول خاص تأمین اجتماعی چالش‌ها وآسیب‌های متعددی را بر نظام تأمین اجتماعی درایران تحمیل می­کند. ضرورت نگارش این مقاله، تبیین اصول و چالش‌های قانون‌گذاری تأمین اجتماعی و ارائه راهکارها برای ارتقاءآن می باشد.
بررسی نظام قانونگذاری تأمین اجتماعی، تحلیل قوانین و بررسی چالش‌های پیش‌روی قانونگذاری در این حوزه و ارائه راهکارهای ارتقاء قوانین حوزه تأمین اجتماعی از اهداف این پژوهش است.
روش پژوهش به صورت توصیفی تحلیلی است و برای نگارش آن از منابع کتابخانه‌ای استفاده شده‌است. یافته‌های این پژوهش بیانگر این موضوع است که رعایت اصول‌ عام قانونگذاری، اصول فنی، ادبی، نگارشی و اصول ‌خاص قانونگذاری تأمین اجنماعی موجب تصویب قوانین با کیفیت بالا در حوزه رفاه و تأمین اجتماعی می‌شود.
