تحلیل اقتصادی صندوق تأمین خسارت‌های بدنی در پرتوی اصول «کارایی» و «هزینه-فایده»

چکیده

هدف: صندوق تأمین خسارت‌های بدنی به منظور حمایت از زیان‌دیدگان حوادث ناشی از وسایل نقلیه تأسیس شده است تا در کنار نهاد بیمه، پاسخگوی جبران خسارت بدنی زیان‌دیدگان باشد. اگرچه مبانی حقوقی و فقهی متعددی ضرورت ایجاد صندوق مزبور را توجیه می‌نماید، لیکن حفظ و استمرار جایگاه صندوق در جامعه بر پایه معیارهای فقهی و حقوقی کافی نیست و بررسی کارایی و مطلوبیت اقتصادی تأسیس مزبور، بنیاد اجتماعی آن را تقویت می‌نماید؛ به همین جهت، در این پژوهش سعی می‌شود تا کارایی صندوق تأمین خسارت‌های بدنی از منظر تحلیل اقتصادی حقوق ارزیابی و توجیه اقتصادی آن امکان‌سنجی گردد.

روش تحقیق: روش پژوهش حاضر تحلیلی و توصیفی است.

نتیجه: ارزیابی کارکرد صندوق تأمین خسارت‌های بدنی در پرتوی نظریات اقتصادی، تقویت بنیاد صندوق بر پایه تحلیل اقتصادی حقوق را به دنبال دارد. احساس امنیت خاطر اجتماعی و نبود بیم ناشی از نقض وظیفه ایمنی حاکمیت، جبران کننده هزینه تأسیس این نهاد از منظر اجتماعی است. سختی توجیه کامل نهادهای اجتماعی با معیار پارتو، ضرورت انطباق کامل با این معیار را از نظر تحلیل‌گران اقتصادی قابل اغماض می‌سازد و ارزش این نهاد اجتماعی را نفی نمی‌کند. بهینگی اقتصادی صندوق بر مبنای قیاس مطلوبیت در کالبد معیارهای فایده‌گرایی، حداکثرسازی ثروت و افزایش رفاه اجتماعی قابل توجیه و بیانگر ضرورت ایجاد و بقای جایگاه صندوق تأمین خسارت‌های بدنی در جبران حوادث رانندگی است و نتیجه این ارزیابی، شکل‌دهنده اندیشه گسترش صندوق‌های جبران خسارت در حوادث غیر ترافیکی است.
