ظرفیت‌های نظام حقوقی ایران برای ارزیابی تأثیرات قوانین در حوزه اقتصاد

چکیده

قانون‌‌گذاری نیز همچون دیگر اعمال حکومتی از فرایند پیچیده و ظریفی تشکیل شده و از ابعاد مختلف قابل بررسی و مطالعه است. از جمله این ابعاد فرایند انجام ارزیابی‌‌هایی است که تصمیم‌سازان باید قبل و بعد از قانون‌‌گذاری به انجام آن متعهد باشند. در این پژوهش به این پرسش پرداخته می‌شود که «ظرفیت‌های نظام حقوقی ایران برای ارزیابی تاثیرات قانون به ویژه در حوزه اقتصادی چیست؟» از طریق روش توصیفی-تحلیلی با استفاده از منابع کتابخانه‌ای این نتیجه حاصل شد که در ایران ظرفیت‌های حقوقی بالقوه‌ای برای ارزیابی تاثیرات قانون به صورت پیشینی و پسینی در حوزه اقتصاد وجود دارد، هرچند که این ظرفیت‌ها تاکنون به صورت صریح و منسجم برای ارزیابی تأثیرات قانون در این حوزه مورد توجه قرار نگرفته‌اند. برخی از این ظرفیت‌های حقوقی اعم از نهادهای حکومتی، نهادهای غیردولتی و صنفی که در این پژوهش شناسایی شده‌اند؛ صرفا به منظور ارزیابی پسینی قوانین می‌توانند مورد استفاده قرار گیرند و در مقابل برخی از این ظرفیت‌های حقوقی می‌توانند در ارزیابی پیشینی و پسینی قوانین مورد استفاده قرار گیرند.
